Welcome to Deshikaj, which we also refer to as the Platform, Website or Site. You can access it at www.deshikaj.com. These Terms and Conditions which we call the Terms or Agreement control how you use Deshikajs website, mobile apps and services. You should take a minutes to read through these Terms. When you create an account or start using Deshikaj you are agreeing to follow this Agreement. If you do not agree to these Terms then you cannot use our services. We want to make sure you understand what you're getting into when using Deshikaj.

1. Definitions

• When we talk about Deshikaj we are talking about the Deshikaj platform and the company that runs it.
• When we say User we are talking about anyone who visits or uses the Deshikaj platform. This includes people who buy services from others and people who sell services to others.
• A Client is someone who uses the Deshikaj platform to find and buy services from a Freelancer.
• A Freelancer is someone who uses the Deshikaj platform to sell services to a Client.
• The Service Contract is an agreement, between a Client and a Freelancer that says what work needs to be done.
• The Platform Services are all the things that Deshikaj does to help people use the platform. This includes the marketplace where people can find each other the way we handle payments the way we resolve disputes and the way we help people connect with each other on the Deshikaj platform.

2. Signing Up. Rules

• Who Can Sign Up: You need to be 18 years old or more and able to make agreements that are legally binding to use Deshikaj. When you create an account you are confirming that you meet these conditions.
• Creating Your Account: You have to give up-to-date and full details when you sign up. You cannot make than one account and you cannot make an account with fake details.
• Keeping Your Account Safe: You are, in charge of keeping your password safe and making sure nobody uses your account without your permission. If someone uses your account without your permission you have to tell us away.

3. Deshikaj is a venue where people meet.

• The relationship, between people who use Deshikaj is simple: Deshikaj is a place that helps Clients find Freelancers. We do not give jobs to Freelancers. We also do not work for any user of Deshikaj. Freelancers are their bosses.
• We can not promise anything will work out: We can not say that the work Freelancers do will be good or safe. We also can not say that Clients will pay for the work they get from freelancers. When Clients and Freelancers work together they do so on their own. Deshikaj is not responsible. Users of Deshikaj have to be careful when they deal with each other.

4. Service Contracts

• Direct Agreement: When a Client gives a project to a Freelancer and the Freelancer says yes they make a Service Contract together. Deshikaj is not part of this Service Contract.
• Independence: The Client and the Freelancer figure out the details of the Service Contract, like what work needs to be done when it is due and what needs to be finished between themselves as long as it does not go against the Deshikaj Terms.

5. Fees, Payments and Taxes

• Platform Fees: Deshikaj charges fees for using the Deshikaj platform. For example Deshikaj charges commissions on completed projects. Deshikaj deducts these fees automatically from payments made through the Deshikaj platform. You can find the fee structures on our Fees Policy Page. Deshikaj can change the Deshikaj fees at any time. Deshikaj will give you notice before making any changes.
• Payment Processing: You have to process all payments through the Deshikaj payment system that Deshikaj designates.
• Escrow System: For fixed-price projects Clients may have to deposit funds into the Deshikaj Escrow system. The funds are for milestones. Deshikaj releases the funds to the Freelancer when the Client approves the work that the Freelancer submits.
• Taxes: You are responsible for figuring out what taxes you have to pay when you use Deshikaj. You have to collect and pay any national or international taxes that apply to your transactions on Deshikaj. This includes taxes, like VAT, income tax or TDS. You have to take care of all the taxes that come from using Deshikaj.

6. Non-Circumvention is an important part of our agreement.

• When you find someone on Deshikaj you have to use Deshikaj for all payments with that person for two years. This means you cannot pay them or get paid by them outside of Deshikaj for any work you do together if it is related to something you started talking about on Deshikaj.
• You cannot pay someone. Get paid by someone outside of Deshikaj for any work you find or talk about on Deshikaj. If you do this your Deshikaj account will be closed forever. You might even get in trouble, with the law. Deshikaj has to be the way you use to pay or get paid by other Deshikaj users.

7. Intellectual Property

• Work Product: When the Client pays in full they own all the rights to the work unless the Client and the Freelancer agree otherwise in the Service Contract.
• Deshikaj Intellectual Property: Everything on the Deshikaj platform like content and logos and designs and software belongs to Deshikaj. The Client cannot. Change or share Deshikaj Intellectual Property without getting permission, from Deshikaj in writing.

8. User. Prohibited Activities

You agree not to use Deshikaj to do things like this.

• Deshikaj is not the place to post things that're not true or that will confuse people.
• You should not use Deshikaj to offer or ask for things that're against the law like services that are only for adults or things that can help people cheat in school or bad software that can hurt computers.
• Do not use Deshikaj to bother or scare Deshikaj users.
• You are not allowed to take information from Deshikaj without permission or use automated programs or try to break into the Deshikaj system.
• You should not write fake reviews on Deshikaj or try to trick the rating system, on Deshikaj.

9. Dispute Resolution

• Amicable Resolution: When the Client and Freelancer have a problem with a Service Contract they will talk to each other to try to resolve the issue in a way.
• Platform Mediation: If the Client and Freelancer cannot agree, either the Client or the Freelancer can ask Deshikaj for help with resolving the dispute. Deshikaj will look at what they said to each other what the project was supposed to do and what was delivered to make a decision, about the money that is being held.

10. Termination and Account Suspension

Deshikaj can stop your account keep your money and not let you use the Platform without telling you if you do not follow these rules get bad reviews all the time or try to cheat. Deshikaj gets to decide what to do. When to do it.

11. Limitation of Liability

• The Platform Services are provided by Deshikaj on an as is basis. This means Deshikaj does not promise that the Platform Services will be perfect. Deshikaj is giving you the Platform Services as they are and you are using them at your risk. Deshikaj says it does not make any promises about the Platform Services and it does not say they will work for what you want to use them for.Deshikaj does this to protect itself.
• Deshikaj will not be responsible for any problems that happen because you used the Platform Services. This includes things like losing money or data. Deshikaj will not pay you more than what you paid to Deshikaj in the six months if something goes wrong.

12. Governing Law and Jurisdiction

The rules of the country where Deshikaj is located will apply to these Terms. If there is a problem with these Terms it will be handled in the courts of the city where Deshikaj is located. Deshikaj and you agree to go to these courts if there is a problem. The city is where the courts are that will handle any problems, with these Terms. You agree to this.

13. Changes to These Terms

We will make changes to these terms sometimes. This is because our business or what the law says might change. When we make changes we will let you know. We do this by putting the terms on the Platform or by sending you an email. If you keep using the Platform after the changes take effect that means you are okay, with the terms.
